A judge rejected the argument by Donald Trump that EPA can unilaterally halt a lawsuit under the Clean Air Act if the president decides not to enforce the law. SpaceXAI therefore continues to face a lawsuit brought by NAACP over alleged pollution from the Colossus data center in Memphis, Tennessee. Trump justified his intervention by citing support for bringing data centers online quickly under his AI Action Plan.
The lawsuit followed a finding that the facility was powered by gas turbines without permits. NAACP is seeking a court order requiring the use of the best available technology to control pollution and penalties of up to 124 426 dollars per day for each violation. According to NAACP, there is a risk of a significant increase in pollution in nearby vulnerable, predominantly Black neighborhoods. These are demands made in the lawsuit, not penalties already imposed.
Why it matters
The proceedings can continue to consider demands to reduce emissions around the facility. A key consideration when assessing the legal risks of operating the facility is that the maximum penalty sought applies to each day and each violation, rather than to the case as a whole.

What this means
For a business
SpaceXAI remains exposed to the risk of court-ordered measures to reduce pollution and financial penalties. The argument that EPA has the authority to halt the lawsuit did not eliminate this risk.
