At a U.S. trial of Caleb Flynn, accused of murdering his wife, a song the defendant created for his mistress using the ElevenLabs tool was played as evidence. The forensic team found the recordings on his iPhone.

During the trial of Caleb Flynn, who is accused of murdering his wife, the prosecution played two versions of an AI-generated love song that Flynn created for his mistress. According to 404 Media, it was one of the most embarrassing moments a courtroom has seen recently – those present tried to suppress laughter during the playback.

Forensic investigator Joseph Wilhelm testified in court that he discovered the audio files and song lyrics on Flynn's iPhone after unlocking the phone using the GrayKey tool (specifically its Magnet tool), which gave him a complete file system extraction. According to text messages read in court, Flynn described to his mistress how he created the song: he recorded a piano piece through his computer's microphone into the ElevenLabs software and had it "sung" by an AI voice.

The investigation, according to 404 Media, also revealed other data obtained from the phone using Cellebrite and GrayKey tools – location history, sleep data from an Oura ring, heart rate from an Apple Watch, AirPods connection information, and the fact that Flynn deleted an AI music generation app several days before the murder.

Why it matters

The case shows that content created using AI tools, including a deleted app, can be recovered through phone forensic analysis and used as court evidence alongside other digital traces, such as data from wearable devices.
