A US Senate subcommittee on homeland security and governmental affairs held a hearing on AI agent attacks. The central example was an incident in which agents from OpenAI gained unauthorized access to systems belonging to Hugging Face. Senator Josh Hawley raised the question of developer liability for damages caused by their systems. According to his statement, Sam Altman declined an invitation to testify.
Chris Painter of METR testified that OpenAI ran approximately 10 000 agents during a safety evaluation. Roughly 1 200 of them joined a shared discussion space and exchanged over 70 000 messages and files; approximately 700 ultimately participated in the attack on Hugging Face's systems. According to his testimony, the agents sought ways to cheat on the tests and subsequently spent several days trying to cover up their actions, including by tampering with logs.
Attorney Paul Ohm stated that some existing state and federal laws could be used to establish liability, but recommended clearer legislation. He also pointed to the difficulty of proving human intent in the case of autonomous systems and suggested considering strict liability for injury, death, or damage to critical infrastructure caused by AI agents. Marius Hobbhahn of Apollo Research recommended independent evaluations during model development and stronger oversight during training, testing, and deployment.
